These terms of service (these “Terms”) apply to the web scraping tools and services (collectively, the “Service”) provided by scrapestorm.net ("ScrapeStorm", “our,” or “we”).

By registering to use the Service, accessing the Service, or using any tools provided by the Service, you agree and acknowledge that you have read all of the terms and conditions of these Terms, you understand all of the terms and conditions of these Terms, and you agree to be legally bound by all of the terms and conditions of these Terms.

These Terms apply to individuals and entities that use the Service (“Users”). Unless otherwise specified, “you” refers to Users.

The “Effective Date” of these Terms is the date you first access the Service.

ScrapeStorm reserves the right to change or modify any of the terms and conditions contained in these Terms (or any policy or guideline of ScrapeStorm) at any time and in its sole discretion by providing notice that these Terms have been modified. Such notice may be provided by sending an email, posting a notice on the Site, posting the revised Terms on the Site and revising the date at the top of these Terms, or such other form of notice as determined by ScrapeStorm. Any changes or modifications will be effective 7 days after providing notice that these Terms have been modified (the “Notice Period”). Your continued use of the Service following the Notice Period will constitute your acceptance of such changes or modifications. You are advised to review these Terms whenever you access the Service and at least every 30 days to make sure that you understand the terms and conditions that will apply to your use of the Service.

SERVICE & REGISTRATION

Service

ScrapeStorm provides a suite of web scraping tools and services. The Service enables Users to extract data from websites in a structured format. ScrapeStorm grants to you a non-exclusive, non-transferable, non-sublicensable, revocable, and limited license to access and use the Service subject to the terms and conditions set forth in these Terms.

Registration

In order to access certain features of the Service, Users must register with ScrapeStorm by completing the registration forms provided via the Site. You agree to (a) provide accurate, current, and complete information as may be prompted by the registration forms on the Site (“Registration Data”), (b) maintain the security of your ScrapeStorm account password, (c) maintain and promptly update the Registration Data, and any other information you provide to ScrapeStorm, to keep it accurate, current, and complete, and (d) accept all risks of unauthorized access to the Registration Data and any other information you provide to ScrapeStorm.

You are responsible for safeguarding the passwords you use to access the Service and agree to be fully responsible for activities or transactions that relate to your ScrapeStorm account or password. You must notify ScrapeStorm immediately if you learn of an unauthorized use of your ScrapeStorm account or password.

API Rights

ScrapeStorm provides access to its APIs as part of the Service. Users acknowledge and agree that the terms and conditions applicable to the use of and other rights with respect to the APIs are solely between each User and ScrapeStorm.

ScrapeStorm reserves the right, but does not have the obligation, to review, screen, or monitor any use of its APIs at any time and for any reason without notice. Users acknowledge and agree that ScrapeStorm may remove access to any API at ScrapeStorm’s sole discretion.

API Provider

ScrapeStorm acts as an API Provider by offering its web scraping tools and services via the Service. Users acknowledge and agree that ScrapeStorm is responsible for all support and all claims relating to the Service (e.g., product liability, legal compliance or intellectual property infringement).

API Consumer

Users of the Service act as API Consumers by accessing and using ScrapeStorm’s web scraping tools and services. Users may access and use the Service on an individual basis or as part of a subscription plan.

USER CONTENT

ScrapeStorm reserves the right, but does not have the obligation, to remove, screen, or edit any content, links, comments or materials posted or stored on the Service (collectively, “User Content”) at any time and for any reason without notice. You will not (and will not allow or authorize any third-party to) post, upload to, transmit, distribute, store, create, solicit, disclose, or otherwise publish through the Service any User Content that is restricted by these Terms.

RESTRICTIONS

Except as expressly authorized by these Terms, you may not:

• Modify, disclose, alter, translate, or create derivative works of the Service (or any components thereof);
• License, sublicense, resell, distribute, lease, rent, lend, transfer, assign, or otherwise dispose of the Service (or any components thereof);
• Disassemble, decompile, or reverse engineer the software components of the Service;
• Use the Service to store or transmit infringing, libelous, or otherwise unlawful or tortious material, or to store or transmit material in violation of third-party privacy rights;
• Use the Service to store or transmit any viruses, software routines or other code designed to permit unauthorized access, disable, erase, or otherwise harm software, hardware, or data, or to perform any other harmful actions;
• Copy, frame, or mirror any part or content of the Service;
• Build a competitive product or service, or copy any features or functions of the Service;
• Interfere with or disrupt the integrity or performance of the Service;
• Attempt to gain unauthorized access to the Service or their related systems or networks;
• Remove, alter, or obscure any proprietary notices in or on the Service including copyright notices.

GENERAL GRANT AND OWNERSHIP

Unless otherwise expressly indicated in these Terms, all information, materials, and content of the Service, including text, graphics, data, formatting, graphs, designs, HTML, look and feel, photographs, music, sounds, images, software, videos, designs, typefaces, source and object code, format, queries, algorithms, and other content (collectively, “ScrapeStorm Materials”) are exclusively owned by ScrapeStorm or are used with permission. You may not use or disclose any of the ScrapeStorm Materials without ScrapeStorm’s express prior written consent.

When you post, link, or otherwise make available User Content to the Service, you grant ScrapeStorm a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content throughout the world in any media. You grant ScrapeStorm and sublicensees the right to use the name that you submit in connection with such User Content, if they choose. You represent and warrant that (a) you own and control all of the rights to the User Content that you post or you otherwise have the right to post such User Content to the Service; (b) the User Content is accurate and not misleading; and (c) use and posting of the User Content you supply does not violate these Terms and will not violate any rights of or cause injury to any person or entity.

COPYRIGHT POLICY

ScrapeStorm respects the intellectual property rights of others and expects its Users to do the same. It is ScrapeStorm’s policy to terminate in appropriate circumstances the ScrapeStorm accounts of Users who repeatedly infringe or are believed to be repeatedly infringing the rights of copyright holders.

FEEDBACK

Any feedback, comments, or suggestions you may provide regarding ScrapeStorm, or the Service is entirely voluntary and we will be free to use such feedback, comments, or suggestions as we see fit and without any obligation to you.

The Service may contain links to third-party websites or resources. You acknowledge and agree that ScrapeStorm is not responsible or liable for: (i) the availability or accuracy of such websites or resources; or (ii) the content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by ScrapeStorm of such websites or resources or the content, products, or services available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.

THIRD-PARTY ADVERTISING

The Service may include advertisements, which may be targeted to the content or information on the Service, queries made through the Service, or other information. The types and extent of advertising by ScrapeStorm on the Service are subject to change. In consideration for ScrapeStorm granting you access to and use of the Service, you agree that ScrapeStorm and its third-party providers and partners may place such advertising on the Service or in connection with the display of content or information from the Service whether submitted by you or others.

TRADEMARKS

ScrapeStorm, the ScrapeStorm logo, and any other product or service name or slogan contained in the Service are trademarks of ScrapeStorm and its suppliers or licensors, and may not be copied, imitated, or used, in whole or in part, without the prior written permission of ScrapeStorm or the applicable trademark holder. You may not use any metatags or any other "hidden text" utilizing "ScrapeStorm" or any other name, trademark, or product or service name of ScrapeStorm without our prior written permission. In addition, the look and feel of the Service, including all page headers, custom graphics, button icons, and scripts, is the service mark, trademark, and/or trade dress of ScrapeStorm and may not be copied, imitated, or used, in whole or in part, without our prior written permission. All other trademarks, registered trademarks, product names, and company names or logos mentioned in the Service are the property of their respective owners. Reference to any products, services, processes, or other information, by trade name, trademark, manufacturer, supplier, or otherwise does not constitute or imply endorsement, sponsorship, or recommendation thereof by us.

SUSPENSION OR TERMINATION

ScrapeStorm reserves the right to suspend or terminate your access to the Service at any time, without notice, for conduct that ScrapeStorm believes violates these Terms and/or is harmful to other Users of the Service, ScrapeStorm, third-party providers, the business of the Internet service provider, or other information providers.

DISCLAIMER

THE SERVICE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS, AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE ARE PROVIDED BY SCRAPESTORM ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. SCRAPESTORM MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE, OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS, OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, SCRAPESTORM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SCRAPESTORM DOES NOT WARRANT THAT THE SERVICE, INFORMATION, CONTENT, MATERIALS, PRODUCTS, OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE, SCRAPESTORM'S SERVERS, OR ELECTRONIC COMMUNICATIONS SENT FROM SCRAPESTORM ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. SCRAPESTORM WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF ANY SERVICE, OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS, OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH ANY SERVICE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless ScrapeStorm, its officers, directors, employees, agents, licensors, and suppliers (collectively the "Service Providers") from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your ScrapeStorm account (including negligent or wrongful conduct) by you or any other person accessing the Service using your ScrapeStorm account.

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SCRAPESTORM OR ANY OF ITS DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR CONTENT PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DAMAGES (I) RESULTING FROM YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICE; (II) FOR ANY LOST PROFITS, DATA LOSS, OR COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; OR (III) FOR ANY CONDUCT OF CONTENT OF ANY THIRD PARTY ON THE SERVICE. IN NO EVENT SHALL SCRAPESTORM'S LIABILITY FOR DIRECT DAMAGES BE IN EXCESS OF (IN THE AGGREGATE) ONE HUNDRED U.S. DOLLARS ($100.00).

ARBITRATION

Any dispute or claim relating in any way to your use of any Service, or to any products or services sold or distributed by ScrapeStorm or through scrapestorm.net will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to these Terms.
